For one, anyone with knowledge of the death is required to report it immediately, and medical workers have up to five days to submit the death certificate. Fines up to $250 and up to 90 days in jail.

That would require testing. And brain death IS death. A death certificate is issues for the time of death being the time brain death was pronounced. I just don't see doctors putting their very licenses in the line to help cover up McConnell's death. I can see them not doing the testing but knowing that he has had a catastrophic brain injury that cannot be recovered from.

Physician here that tested for brain death on multiple Neuro ICU patients my intern year. That's easier said than done. Brain death includes assessing spinal reflexes like pinching the trapezius and nail beds really hard. A brain dead person will pull away the same way every single time. Any variation in this response on repeat attempts means there is some cerebral filtering/feedback so you cannot say brain dead. Normally in these circumstances you also assess apnea test where you withdraw vent settings. But usually that's with family approval to let their loved one go when you do this.
He could very well be responsive enough to not legally and medically be brain dead despite all physicians knowing he's perma vegetable yet the powers to be don't want him to pass on for political reasons

My partner became a nurse a little over a year ago and he has such an amazing brain. What I mean by that is it we have had some trauma in our past including losing our only child to cancer. When he became a nurse and started thinking about what he wanted to specialize in he decided that since he likes kids so much he wanted to either work in the NICU or work in pediatric oncology. I have a medical background but I promise you if I ever went to nursing school I would be running from those positions as far as I could. I know I couldn't handle it and I just know I wouldn't be able to do it. He loves it and he loves feeling like he's doing everything he can to save other kids. It's absolutely beautiful and I respect him so much for it. I just know that no matter how much I wanted to do it I simply couldn't. So when the days are a little hard I listen and send him in with extra treats to work the next day when I can.

I really am too. I cannot tell you the kindness and grace of all the people in pediatric oncology. It was very obvious they did their best and as my son's cancer (clear cell sarcoma) was really rare and aggressive they had never seen it before. I got to watch them struggle to understand why absolutely nothing seemed to work. In a way it felt like they were having the same struggles that we were. When he mentioned that that was one of the places he was thinking of working it was really hard to have a supportive answer right off because I can't even ride past that building without feeling A LOT. The fact that he could do that and feels so fulfilled and thrilled about it is something I super admire and also envy. I simply couldn't do it.
Definitely hold your little ones tight. My son looks so healthy and nobody could believe it when he was diagnosed with cancer right after his 18th birthday. We were really lucky in the sense that the statistics for average life/survival after diagnosis from that cancer are only a few months. We got a year and 4 months. The pandemic might have helped with that because getting into ORs within 24 hours when it was determined he needed them was absolutely brilliant. At one point a decision was made at 8:00 a.m. and he was in the OR for a chest line within 5 hours. Kind of like Charles Dickens - "It was the best of times and the worst of times." I won't pretend that I think I've recovered much at all from that, but my partner has found a way to grow from it and I am so grateful that this didn't manage to destroy him and manage to help him grow. I'm hoping for that myself as I move forward.
On a sad note I found out through an accident / local gossip that 5 years on after my son's diagnosis another child came in with clear cell sarcoma. It was in his foot near his toes. I understand from the person who told me that the pediatric oncology clinic explained exactly how aggressively the clinic warned the parents about the cancer and instead of just taking part of his foot they took all of it in the hopes that if any of the cancer had moved at all they caught it. The person who is gossiping to me knew that my son was gone from cancer but did not know she was specifically talking about my kid as the one that compelled the extra uegent aggressive response to the cancer from the oncology clinic. I really hope that that kid is okay. I'm horrified to hear that anybody gets this cancer now and I'm so glad it is rare.

It can be even more complex in adults in my experience. A whole checklist of reflexes. Extensive bloodwork to rule out any theoretical reversible cause. Can also require elaborate perfusion scans, which radiologists often will not give an absolutely definitive answer as to not take on liability. If a family really wants to threaten everyone with frivolous lawsuits, it can take some balls to just follow the law on brain death is death even if it’s 99.9999% certain. Maybe there’s some variance by state on the exact details too?
I agree that it’s possible he has some primitive brainstem function, but no chance at meaningful recovery. But it’s all speculation. Which is what we’re left with in the absence of definitive information.

radiologists don't have anything to do with brain death which simply requires a neurologist to diagnose. if imaging is required, the neurologist will utilize the radiologist's interpretation of images or interpret images themselves
even the person you're responding to is incorrect. brain death is straightforward, but most hospitals do not have a policy to allow for withdrawal of care against the will of the surrogate decision maker due to how fraught those situations can become medicolegally

Well, the crime would be failure to report the death. It’d be difficult to prove whether it was financially-motivated that they hid the news, particularly since he and his wife are quite wealthy and it’s basically a non-issue to get the funds back. They can be reversed easily— I work in Treasury for a F500 & was an auditor for FI’s. If the money couldn’t be recalled for some reason, it’d be added to the claim and crimes.
ACH payments (which is most likely how he gets paid, like you, via direct deposit) are recalled all the time. If, for some reason, he actually got paid via physical check, they can put a “stop payment” on it if it hasn’t been deposited. If it has, it’s a different return process but it’s a common thing in my day to day.

Kentucky citizen checking in. Beshear is far too congenial to do it. I'd bet money that, if we could look into his head and heart, Andy knows he's dead. He just doesn't want to stir a news cycle about it because it'd be easy fodder for right-wing media. And what's easy fodder for right-wing media is a nuisance when you're a Democratic Governor in a very red state.
I think the other part of the calculus is, what does it hurt other than confidence in Republicans? They've lost their margin, Dems won't turn MAGA in the next few months and push legislation through, and McConnell was already a non-issue after this November.
So Beshear, keeping his posture in the lead up to 2028, has to keep a calm and measured demeanor to stay on brand. He has to seem responsible rather than hysterical. I'm surprised he even said this much on the record.
Not to say this whole situation isn't a big deal or general madness. Just that the juice isn't worth the squeeze with the current rules.

This is probably him gearing up to do so. He is now claiming he has had reports McConnell is dead. He intends to use that claim to call the special election, forcing the hand of McConnell's camp. At that point either Beshear succeeds, or McConnell will have to be wheeled out for everyone to see. Even if they try to fight it in court, his condition will come out.

He should file a suit challenging the modified Kentucky succession laws, promote a referendum to change them, and initiate a special election NOW while these issues are in process. The incident occurred in DC. Previously McConnell & office have been way more transparent about health concerns, falls, treatments. Beshears got calls from two non state agencies suggesting McConnell’s death. DC ems report to the mayor via the fire chief. Trumps fingerprints seem likely. Notice how the only thing he’s said is he has no idea about McConnell’s health? Does anyone believe that?

Call the special election.
Mitch can dispute it if he's of sound mind and body. If not, move forward and elect a representative for the people of Kentucky.
